LLG have today made representations to include local authority lawyers in the definition of Key Worker for the purpose of school provision for dependants. A number of officers are already earmarked to be included within the definition such as social workers, planning officers and environmental health officers who will require the support of lawyers to undertake their roles. This is alongside the pressing need for lawyers to underpin the governance of their local authority.

The legislation establishing the regulatory framework for the provision of Hackney Carriage and Private Hire services outside of London has failed to keep pace with both technology and the Government’s deregulation agenda. This places a heavy burden on Councils who struggle to maintain public protection with reduced resources and an ever more inventive trade who look to exploit the loopholes, weaknesses and inconsistencies that continue to exist despite demands for reform. In December 2019 the Court of Appeal issued its Judgment in the case of R (on the application of Rehman) v Wakefield City Council & the Local Government Association. This has provided a useful clarification of the basis upon which Councils should calculate their fees under the Hackney Carriage and Private Hire licensing regimes.
